With respect to internet use, we base the protection of your personal data on the Telemedia Act (TMG) that applies in the Federal Republic of Germany.

Personal data – according to section 3 (1) BDSG (German Privacy Act) this is

“individual information about the personal or factual circumstances of a specific person or identifiable person (the person affected).”-

is only collected to the extent that it is technically required when you visit this website.

Collection and processing of personal data

Personal data includes data such as your name, address, your account number, identification number, your telephone number or your email address. Moreover, we shall only collect, process or use your personal data if you have voluntarily disclosed this to us and if it is permitted in law, or if you have provided your consent. This usually happens when you enter into a business transaction with us or if you submit an enquiry to us. The data that you have entered when registering on our website will, of course, always be encrypted when it is transmitted.

Designated purpose, use and disclosure of collected data

We shall only use the personal data that you have supplied to us for the purposes that we have already stated or agreed, in other words this will generally be for the purpose of handling the contract that we have concluded with you or in order to reply to your enquiry.

If you make use of our services, only the data that we require to provide the service will generally be collected. If we request any additional data from you, this information will always be supplied on a voluntary basis. Personal data will only be processed in order to provide the service that has been requested or to protect our own legitimate business interests.

Is personal data disclosed to third parties?

Data that has been collected is never sold or disclosed to third parties, unless this is required in order to execute the contract or to provide the service. Data will only be provided to authorities or government institutions that have the right to obtain information if there is an obligation to disclose this information or if there has been a judicial decision. In these cases, we will submit as little data as possible.

Protection of children and minors

Children and young people with limited legal capacity may not submit personal data on our website without the permission of their parents or legal guardian. 42 GmbH will never knowingly collect personal data from children or young people with limited legal capacity, or use it in any way or disclose it to third parties without authorization.

Video surveillance

The sole purpose of video surveillance at our corporate locations is to collect evidence in the event of vandalism, burglary, assault or other crimes. When video cameras are present or in use, this is indicated by the relevant warning notices.


Cookies are small files that are sent by a webserver to your browser and are stored on the hard drive of your computer. This means that none of the user’s personal data is stored apart from the Internet Protocol address. This information helps to automatically recognize you during your next visit to our website and makes navigation easier for you. When you visit our websites, our webservers automatically save general information in an anonymous form which is then used for the purpose of marketing and improvements. This website uses Google Analytics which is a web analysis service belonging to Google Inc. (“Google”). Google Analytics uses “cookies”.

The full IP address will only be passed on to a Google server in the USA and truncated there in exceptional cases. Use of Google Maps

This website uses Google Maps to show maps and to create route maps. Google Maps is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Data may be disclosed to the following recipients:

Public offices which receive the data due to legal regulations (e.g. social insurance carriers)

Internal departments involved in carrying out the relevant business processes (e.g. human resources management and regulation, accounts, marketing, sales, IT organization and the central reservation services (customer service center)

External agents (service companies) according to section 11 BDSG

• Other external bodies (e.g. credit institutions, brokerages acting as intermediaries, companies that belong to the company group if the party concerned has consented in writing or if disclosure is permitted due to an overriding legitimate interest), and partner companies when conducting contractual work on behalf of the customer

Right to information

According to section 34 BDSG, you are fully entitled to receive information about the data we have stored as well as the right to have unacceptable data deleted or blocked and incorrect data corrected free of charge according to section 35 BDSG. If you submit a request, we shall respond in writing as quickly as possible and according to applicable law, stating whether and what kind of personal data we have stored. If we have stored incorrect information in spite of our efforts to store accurate and current data, we shall, of course, correct this upon your request.

Time limits for deleting data

Data is deleted after the retention periods prescribed by the law, the articles of association or contracts have expired. Data that is not subject to retention periods is deleted when it is no longer required for the specific purpose.

Changes to the data protection policy

We reserve the right to change our data protection practices and to change this policy so that it conforms with possible changes in relevant laws and regulations or in order to be able to better meet your requirements.
